Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Domain Investor Club website at domaininvestorclub.com, our membership, and our services. Domain Investor Club ("we," "us," or "our") is based in Omaha, Nebraska, United States. By creating an account, starting a membership, or purchasing a package, you confirm that you have read, understood, and agree to these Terms. If you do not agree with them, please do not use our services. These Terms work alongside our Privacy Policy, Cookie Policy, Acceptable Use Policy, Membership Agreement, and Disclaimer, all of which are part of your agreement with us.
1. Definitions
"Member" means a person who holds an active membership with us. "Membership" means the recurring subscription that grants access to our private domain inventory, member dashboard, and resale service. "Package" means a one-time purchase of a set number of domains under one of our plans (Starter, Growth, or Scale). "Domain" means a web address assigned to you under a package. "Resale Service" means our work of valuing, listing, marketing, negotiating, and closing the sale of your domains. "Commission" means the percentage of a completed sale that we retain as payment for the Resale Service. "Inventory" means the private collection of domains we make available to members.
2. Eligibility
You must be at least 18 years old and able to enter into a legally binding contract to use our services. By using Domain Investor Club, you confirm that you meet these requirements, that the information you provide is accurate and current, and that your use of our services is lawful in your country. We may decline, suspend, or close any account where these conditions are not met, or where local law restricts your use of our services.
3. Accounts
To use most of our services you must create an account. You are responsible for keeping your login details secure and for all activity that occurs under your account. Tell us promptly at [email protected] if you suspect any unauthorized use. You agree to provide accurate account information and to keep it up to date. We are not responsible for losses arising from your failure to keep your credentials secure.
4. Membership
Membership costs $49.99 per month, billed every three months ($149.97 per quarter) in US dollars. Your membership unlocks the private Inventory, your member dashboard, the Resale Service, and access to member support. Membership renews automatically at the end of each quarterly term until you cancel. You may cancel at any time before your next quarterly billing date, which stops all future charges, and you keep access for the remainder of the period you have already paid for. Cancelling does not refund fees already paid, as set out in our Refund Policy and Membership Agreement.
5. Packages and Purchases
Packages are a one-time purchase, separate from your membership. At the time of these Terms, pricing is: Starter (2 domains at $425 each, $850 total), Growth (3 domains at $400 each, $1,200 total), and Scale (5 domains at $375 each, $1,875 total). The price shown to you at the point of purchase is the price that applies to your order. We may adjust package pricing for future purchases, but doing so does not change a purchase you have already completed. A membership is required to purchase any package.
6. Domain Assignment and Ownership
After you complete a package purchase, we assign domains to you from our vetted Inventory and show you each name along with the reasoning behind it. Once assigned, the domains are held for your benefit and are sold only with your approval. While a domain remains under our management as part of the Resale Service, you agree not to transfer, list, sell, or otherwise dispose of it outside the Resale Service, as this would interfere with the service we provide and with active sale efforts. You retain your ownership interest in the assigned domains subject to these Terms.
7. The Resale Service
we value, list, market, and negotiate the sale of your assigned domains, and we manage the transfer and collection of funds when a sale closes. We aim to complete a sale within twelve months of assignment, but we do not guarantee that any domain will sell, that it will sell within any particular time, or that it will sell at any particular price. Whether a domain sells, and for how much, depends on buyer demand and market conditions that are outside our control. You approve the final sale price before any domain is sold, and we do not close a sale without your approval. The Resale Service is a service, not an investment product, and we are not your broker, agent for investment purposes, or financial adviser.
8. Your Approval and Communication
We handle all communication and negotiation with buyers. When a sale reaches a final price, we present it to you through your dashboard or by another agreed method, and you may accept or decline it. If you do not respond to an offer, we will not close the sale. You agree to keep your contact details current so we can reach you about offers and account matters.
9. Commission and Payouts
When one of your domains sells, we retain a Commission based on your package: 17% for Starter, 13% for Growth, and 10% for Scale. The remainder of the sale proceeds is paid to you in US dollars after the sale completes and funds clear. Commission is charged only on a completed sale; if a domain does not sell, no Commission is charged on it. You are responsible for providing accurate payout details, and we are not responsible for delays or losses caused by incorrect information you supply or by your payment provider.
10. Renewals
Our goal is to sell each domain within twelve months. If a domain has not sold within that period, you may choose to keep it on the market by renewing it for $50. Renewal is optional. We do not renew domains automatically and do not charge renewal fees without your instruction. If you choose not to renew, we will let the domain leave your managed portfolio in line with the process explained to you at the time.
11. Payments, Currency, and Taxes
All fees, purchases, and payouts are handled in US dollars. Payments are processed by third-party payment processors, and by paying you also agree to their applicable terms. You are responsible for any taxes, duties, currency conversion costs, or bank charges that apply to you under the laws of your country, and for reporting and paying any taxes due on amounts you receive. We are not responsible for fees charged by your payment provider or bank.
12. Member Conduct and Acceptable Use
You agree to use our website and services lawfully and in good faith, and to follow our Acceptable Use Policy, which is part of these Terms. Among other things, you agree not to misuse the site, attempt to access areas or data you are not authorized to access, interfere with the operation of the service, scrape or copy the Inventory, attempt to bypass the Resale Service, or use the service for any fraudulent or unlawful purpose. Breaking these rules may lead to suspension or termination.
13. Intellectual Property
The content, branding, text, design, and other materials on the Domain Investor Club website are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from them without our written permission. This does not affect your ownership interest in the domains assigned to you under a package.
14. Third-Party Services
Our services rely on third parties such as payment processors and domain transfer or escrow agents. We are not responsible for the acts, omissions, or terms of those third parties, although we choose providers we consider reliable. Your use of a third-party service may be subject to that provider's own terms and privacy policy.
15. Disclaimers
Our services are provided on an "as is" and "as available" basis, without warranties of any kind except those that cannot be excluded by law. We do not guarantee that any domain will sell or generate a profit, that the website will be uninterrupted or error-free, or that any particular result will be achieved. Domain investing carries risk, and outcomes vary. Please read our separate Disclaimer for the full statement on results, earnings, and risk, which forms part of these Terms.
16. Limitation of Liability
To the fullest extent permitted by law, Domain Investor Club is not liable for any indirect, incidental, special, or consequential losses, including lost profits, lost opportunity, or loss of anticipated sale proceeds, arising from your use of our services. Our total liability for any claim relating to the services will not exceed the total amount you paid to us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law, including liability for fraud.
17. Indemnification
You agree to indemnify and hold harmless Domain Investor Club and its team from claims, losses, liabilities, and reasonable expenses arising from your breach of these Terms, your misuse of the services, or your violation of any law or third-party right.
18. Suspension and Termination
We may suspend or close your account if you breach these Terms or our Acceptable Use Policy, provide false information, use the service unlawfully, or create risk for us or other members. You may close your account at any time by cancelling your membership. On termination, any Commission owed on sales already completed remains payable, and the sections of these Terms that by their nature should survive, including those on Commission, intellectual property, disclaimers, liability, indemnification, and dispute resolution, will continue to apply.
19. Force Majeure
We are not responsible for any failure or delay in performing our obligations caused by events beyond our reasonable control, including outages, failures of third-party providers, acts of government, natural events, or disruptions to payment or internet infrastructure.
20. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where the changes are significant, take reasonable steps to notify members. Continuing to use the services after changes take effect means you accept the updated Terms. If you do not accept a change, your option is to stop using the services and cancel your membership.
21. Assignment
You may not transfer your rights or obligations under these Terms to anyone else without our written consent. We may transfer our rights and obligations under these Terms to a successor or affiliate, for example as part of a reorganization, merger, or acquisition, without reducing your rights under these Terms.
22. Severability and Waiver
If any part of these Terms is found to be unenforceable, the rest remains in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.
23. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, Membership Agreement, and Disclaimer, make up the entire agreement between you and us regarding the services, and replace any earlier understandings on the same subject.
24. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Nebraska, United States, without regard to its conflict-of-law rules. If a dispute arises, we ask that you contact us first so we can try to resolve it directly. Any dispute that cannot be resolved informally will be settled by binding arbitration seated in Omaha, Nebraska, except where the law of your country gives you a non-waivable right to bring a claim in your local courts or before a local body, in which case that right is preserved. Nothing in this section prevents either party from seeking urgent injunctive relief where appropriate.
